It's possible to acquire some OF units when still in Indy. Players that went to the trouble of getting them might very well use them for city defense.

To stop having that person as an opponent... Try asking them to become a Friend.
You never battle Friends in PvP.

And if they're unwilling to be a friend you can always remember the player's name and choose a different opponent that round or refresh to obtain a new set of opponents.
